Terms of Use

These Terms of Use ("Terms") govern your use of Emberway for iPhone (Bundle ID: co.dawnapps.emberway) and the related pages on dawnapps.co(together, the "Services"), provided by Dawn Apps ("Dawn Apps," "we," "us," or "our").

By using Emberway you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1. Who can use Emberway

Emberway is for adults. You must be at least 18 years old to use it. By confirming your age in the app, you tell us that you are.

2. What Emberway is, and isn't

Emberway is a self-help tool for adults who want to step away from pornography. It offers website blocking and app locks through Apple's Screen Time, guided exercises for difficult moments, if-then plans, check-ins, progress tracking, an optional partner feature, and a chat companion called Ember.

Emberway is not therapy, medical care or a crisis service, and it does not diagnose or treat any condition. It does not replace help from a doctor, therapist or counselor. If you are in danger or thinking about harming yourself, contact your local emergency number or a crisis line right away.

Where the app describes research (for example, studies of the skills it teaches), that research was not a study of Emberway, and results vary from person to person.

3. Protection and its limits

Protection uses Apple's Screen Time on your phone: Apple's adult-website filter, a list of adult sites we add to it, and locks on the apps you choose. Blocking reduces access but cannot catch every site or every piece of content, and it does not block content inside apps you have not locked. Turning protection off inside Emberway waits 24 hours, but you can remove Emberway's Screen Time access in your iPhone's Settings at any time. We do not guarantee that any content will be blocked.

4. No account

Emberway does not use accounts. Your information stays on your phone as described in the Privacy Policy, which means that if you delete the app or lose your phone, that information is gone. Your subscription follows your Apple ID and can be restored on a new phone.

5. Subscriptions and free trial

Emberway requires a subscription. It is offered yearly, with a free trial, and monthly. Prices are shown in the app before you buy and may vary by country. Payment is charged to your Apple ID at confirmation of purchase, or at the end of the free trial if you start one.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID settings or at Apple Subscriptions. If you cancel during a free trial before it ends, you are not charged. Any unused part of a free trial ends when you buy a subscription. The app sends a reminder the day before a trial ends, if notifications are on.

Refunds are handled by Apple under Apple's policies. You can restore purchases with "Restore purchases" in the app. If a subscription ends, nothing on your phone is deleted; the app's features stay locked until you subscribe again, except the help screens.

6. Talking with Ember (AI)

Ember's replies are written by an AI model. They are meant to help you in the moment, but they can be wrong, incomplete or unsuitable for your situation, and they are not professional advice. Use your own judgment. Do not use the chat to share other people's private information. The chat has a daily limit.

7. Partner feature

If you invite a partner, they will receive the notes you chose (see the Privacy Policy). Only invite someone you trust, and only someone aged 18 or over. A partner receives information from Emberway but has no control over your phone. You can end a partnership at any time; it ends after 24 hours, and your partner is told. If you are a partner, use what you receive only to support the person who invited you.

8. Acceptable use

You agree not to:

• Use the Services if you are under 18.
• Use the partner feature or the chat to harass, threaten or monitor someone without their agreement.
• Try to break, overload, reverse-engineer or get around the Services or their limits.
• Use the Services for anything unlawful.

9. Intellectual property

Emberway, its design, text, Ember and its other content belong to Dawn Apps or our licensors. We grant you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, under these Terms and Apple's rules. What you write in the app is yours.

10. Pre-release versions

Test versions (for example through TestFlight) may change, contain bugs or stop working. Please report problems to us.

11. Ending use

You can stop using Emberway at any time. "Delete everything" (You, then Privacy) erases your data as described in the Privacy Policy. We may suspend access to features that use our server if these Terms are broken.

12. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent the law allows, we make no promises that they will be uninterrupted, error-free, or that they will produce any particular result, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

13. Limitation of liability

To the fullest extent the law allows, Dawn Apps will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid for Emberway in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

14. Relationship with Apple

These Terms are between you and Dawn Apps only, not Apple. Apple is not responsible for Emberway or its content. Apple has no obligation to provide maintenance or support for Emberway. To the extent permitted by law, Apple has no other warranty obligation for Emberway; if the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any.

Apple is not responsible for addressing any claims by you or any third party relating to Emberway, including product liability claims, claims that the app fails to conform to legal requirements, and consumer protection claims. If a third party claims that Emberway infringes their intellectual property, Dawn Apps, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.

You confirm that you are not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's Licensed Application End User License Agreement also applies.

15. Changes to these Terms

We may update these Terms. We will change the date at the top and, for meaningful changes, tell you in the app before they apply. Continuing to use Emberway after that means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws applicable in your country or region of residence, except where prohibited by mandatory local law. Nothing in these Terms limits consumer rights that cannot be waived under applicable law.
